What if you had to take a breathalyzer test before the car would start every time you wanted to drive? In Texas, this situation may occur if you are found guilty of driving while intoxicated (DWI) and are ordered to have an ignition interlock device (IID) installed in your vehicle.
An IID prevents a vehicle from starting if the driver has been driving. Similar to a breathalyzer, it measures the alcohol in a person’s system. If the amount of alcohol on the driver’s breath surpasses a pre-programmed level, then the interlock temporarily locks the vehicle’s ignition.
A first-time offense for a DWI in Texas is considered a misdemeanor, punishable by a jail sentence ranging from 72 hours to 180 days (up to one year in jail if 0.15% or more), 90 days to one year license suspension, and an annual fee of $1,000 or $2,000 for three years to retain driver license. Under state law, however, those convicted of DWI with a BAC less than 0.15% could be able to drive as long as they have an ignition interlock system installed in their vehicle.
If you are eligible to obtain an IID, you must visit an IID center to have the device installed in your vehicle. Expect to pay anywhere from $50 to $200 for installation, in addition to $50 to $100 per month due to rental fees. You are required to conduct any maintenance and calibration.
As soon as it is installed, you will be required to blow into the IID and successfully pass a breath test prior to starting your car. To prevent other individuals from blowing into your device, you must also perform several random breath tests while the vehicle is in motion, typically every 20 minutes or so.
