Felony Grand Jury
Before you are formally charged with a felony, your case must be presented to the Collin County Grand Jury. The Grand Jury decides whether the District Attorney's Office can bring felony charges against you. In many counties, this is simply a formality. If the grand jury okays the filing of felony charges, it will issue a felony indictment against you. At this point you will have been indicted for a felony, and you should definitely retain a felony criminal defense attorney if you have not already done so. If the grand jury meets and you are not indicted on your felony arrest, the felony case against you is essentially dismissed before county felony charges were filed. However, the District Attorney could try for a second felony indictment down the road, but rarely do so. Accordingly, you can challenge county felony charges before the felony case is even filed by hiring a good criminal defense lawyer to fight the felony indictment at the Grand Jury stage - and possibly get a dismissal. At Peveto Law, we have had success submitting felony "grand jury packets" to the McKinney Grand Jury in Collin County that resulted in the felony charges being dismissed, or "no billed." Fighting your felony case at the Grand Jury level is especially advisable in felony DUI and Texas drug cases, as there are often constitutional issues that arise.
