Domestic Assault | Family Violence Charges
In Texas, Family Violence assault refers to an assault against a family member, household member, or person with whom you are in a dating relationship. This is very broad, and includes uncles, cousins, in-laws, and anyone you have ever dated. The bottom line is this – you do not want to be convicted or plead guilty to a Class A Misdemeanor Assault / Family Violence Charge if you can help it – primarily because a Domestic Assault Record greatly limits your options in the future. Once you plead guilty to family violence, it stays on your record as a "family violence" offense forever.
Texas Domestic Assault - Legal Definitions
- ASSAULT - FAMILY VIOLENCE "Family violence" means: (1) an act by a member of a family or household against another family member or household member that is intended to result in physical harm, bodily injury,or assault,(2) a threat that reasonably places the member in fear of imminent physical harm, bodily injury, assault, or sexual assault, but does not include defensive measures to protect oneself; (3)abuse by a member of a family or household toward a child of the family or household; or (4) dating violence
- DEFINITION - FAMILY MEMBER A "Family Member" includes individuals related by three degrees of consanguinity or two degrees of affinity (essentially all relatives up to 2nd or 3rd cousins and all in-laws), individuals who are former spouses of each other, individuals who are the parents of the same child, without regard to marriage, and a foster child and foster parent, without regard to whether those individuals reside together.
- ASSAULT - DATING VIOLENCE (a) "Dating violence" means an act by an individual that is against another individual with whom that person has or has had a dating relationship and that is intended to result in physical harm, bodily injury, or assault or (b) that is a threat that reasonably places the individual in fear of imminent physical harm, bodily injury, assault, or sexual assault, but does not include defensive measures to protect oneself. (c) For purposes of this title, "dating relationship" means a relationship between individuals who have or have had a continuing relationship of a romantic or intimate nature.
- DEFINITION - HOUSEHOLD A "Household" means a unit composed of persons living together in the same dwelling, without regard to whether they are related to each other.
